Single Risk Assessment Document: Legal Context
Law No. 91-1414 of December 31, 1991
Concerns the employer’s obligation to assess (identify and classify) risks realted to the health and safety of workers.
Following this assessment, the employer must implement appropriate preventive actions aimed at reducing the identified risks.
This law is transcribed in the French Labour Code under Article L4121-3.
Decree No. 2001-1016 and Circular DRT No. 6 of April 18, 2002
Transcribed in the French Labour Code under Articles L4121-1 to 3 and R4121-1 to 4, this decree requires the employer to record and update, in a Single Risk Assessment Document (DUERP) , the results of the risk assessment. It also specifies the minimum required updates, namely:
- At least once a year,
- Whenever any modification affects health, safety, or working conditions,
- Whenever new information concerning the assessment of a risk in a work unit is collected, or when a new risk is identified (following an accident at work or otherwise). The decree also defines the list of individuals to whom the DUERP must be made available.
